Merchant / Partner Terms

1. Introduction
These Merchant Terms (“Merchant Terms”) apply to Sellers (“you”, “Partner”, “Merchant”) who use the Creativemark platform to sell digital products. By registering as a Seller, you agree to these Merchant Terms in addition to the platform’s Terms and Conditions.
2. Merchant obligations
- Provide accurate and up-to-date business information, including legal company name, registered address, and tax identification numbers.
- Ensure that you hold the rights and authorisations to sell the products and licence keys you list on the Platform.
- Provide product descriptions that are accurate, complete, and not misleading.
- Comply with all applicable laws, including consumer protection law (Consumer Rights Act 2015), data protection law (UK GDPR), and tax obligations.
- Provide customer support and respond to customer enquiries within a reasonable timeframe (maximum 3 working days).
- Honour valid refund requests in accordance with our Refund Policy and applicable law.
3. Verification and KYC
We may require you to complete identity and business verification (Know Your Customer) before activating your account, receiving payouts, or at any time during your use of the Platform. Failure to complete verification may result in account suspension or payout withholding.
4. Commission and fees
Creativemark charges a commission on each successful sale. The commission rate is agreed during onboarding and may vary by product category. Additional payment processing fees charged by third-party payment providers are deducted from the sale proceeds.
5. Dispute cooperation
You authorise Creativemark to compile and submit evidence to payment providers to defend against chargebacks and disputes on your behalf. You must respond to evidence requests within 3 working days and provide all requested documentation.
6. Payouts
Payouts are subject to the Partner Payout Terms. All payouts are conditional on verification, available balance, and the absence of unresolved disputes or compliance concerns.
7. Termination
Either party may terminate the merchant relationship with 30 days’ written notice. We may suspend or terminate your account immediately if you breach these Merchant Terms, the Acceptable Use Policy, or applicable law. Outstanding payouts will be processed net of any chargebacks, refunds, or fees owed.
8. Liability
You are responsible for the products you sell, including their quality, legality, and compliance with applicable licencing terms. You agree to indemnify Creativemark against any claims, losses, or liabilities arising from your products or your breach of these Merchant Terms.
